1. Definitions
In these Terms and Conditions, the following terms have the meanings given below:
- "Briarsteep" / "We" / "Us" / "Our" — refers to Briarsteep, operating from 78 Jalan Ampang, 50450 Kuala Lumpur, Malaysia.
- "You" / "User" / "Client" — any individual or household that engages with our website or purchases one of our services.
- "Services" — the administrative documentation support services described on our website, including Family Reference Index Build, Inter-Sibling Operating Agreement Workshop, and Long-Range Family Documentation Retainer.
- "Agreement" — these Terms and Conditions together with any engagement letter or service order you and we have agreed.
- "Coordinator" — a Briarsteep documentation coordinator or facilitator assigned to deliver a service.
2. Acceptance of Terms
By using our website or engaging any of our services, you confirm that you have read, understood, and agree to these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding arrangement. If you are acting on behalf of a household or family unit, you confirm that you are authorised to do so.
These Terms apply from the date you first use our website or contact us regarding a service, whichever is earlier.
3. Service Description
Briarsteep provides non-regulated administrative and informational support services to households in Malaysia. Our services are documentary and organisational in nature. They do not constitute legal advice, financial advice, medical advice, or any other form of regulated professional service.
Our three current service offerings are:
- Family Reference Index Build — a one-month engagement to produce a household document index (RM 1,780).
- Inter-Sibling Operating Agreement Workshop — a one-day facilitated workshop producing a written informal arrangement among adult siblings (RM 720).
- Long-Range Family Documentation Retainer — an annual on-call support arrangement for household administrative tasks (RM 4,260).
Service availability is subject to coordinator capacity. We will confirm availability before any engagement begins.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information when requested
- Use our website and services for lawful purposes only
- Not attempt to interfere with the website's infrastructure or security
- Not misrepresent your identity or the nature of your household's documents
- Cooperate reasonably with any coordinator assigned to your engagement
- Obtain any necessary consent from other family members whose personal information may be involved
You are responsible for keeping any login credentials or access materials we provide during an engagement secure.
5. Intellectual Property
All content on our website — including text, layout, and design — is the property of Briarsteep and may not be copied, reproduced, or redistributed without our written consent.
Deliverables produced during your service engagement (such as a printed household index or written operating arrangement) are intended for your household's private use. They are provided for personal, non-commercial reference purposes.
You retain ownership of the underlying documents and records you share with us. We hold no claim over your household's personal records.
6. Fees & Payment
All fees are quoted and payable in Malaysian Ringgit (RM). Current service fees are as listed on our website. We reserve the right to update pricing for new engagements; fee changes do not affect in-progress engagements already confirmed.
Payment terms will be detailed in the engagement letter. For most services, a deposit is required before work begins, with the balance due upon completion or at agreed milestones.
Accepted payment methods include online bank transfer and other methods communicated at time of engagement.
Refunds are considered on a case-by-case basis if a service cannot be delivered as agreed due to circumstances within our control. We will communicate the outcome of any refund request within 14 business days.
7. Service Delivery
We will make reasonable efforts to deliver services within the timeframes outlined in the service description and confirmed at the time of engagement. Timelines may be affected by the availability and completeness of materials provided by you.
All services are administrative in scope. We do not provide regulated professional advice of any kind. Deliverables are informal organisational tools and should not be treated as substitutes for advice from a qualified professional where such advice is appropriate.
Significant changes to the agreed scope of work may require a revised timeline and fee; we will discuss this with you before proceeding.
8. Disclaimers
Our services are administrative and informational. We make no representations about the accuracy, completeness, or fitness for purpose of any output we produce. An index is a reference tool; it does not verify the validity or currency of the documents it lists.
Nothing we produce constitutes legal, financial, tax, or regulatory advice. If you need advice in any of these areas, please consult a qualified professional.
Our website is provided "as available". We do not guarantee uninterrupted access and take no responsibility for data loss resulting from technical issues outside our control.
9. Limitation of Liability
To the extent permitted by Malaysian law, Briarsteep's total liability for any claim arising from an engagement is limited to the fees paid for that specific engagement.
We are not liable for indirect, consequential, or special damages, including loss of data, loss of income, or any harm arising from reliance on the content of any deliverable we produce.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Malaysian law.
10. Indemnification
You agree to indemnify and hold harmless Briarsteep, its coordinators, and affiliates from any claim, loss, or expense (including reasonable legal costs) arising from your misuse of our services, your breach of these Terms, or any inaccurate or incomplete information you provide to us.
11. Termination
Either party may end an engagement by giving written notice. If you end a service engagement before it is complete, fees may be due for work already performed, as detailed in the engagement letter.
We may suspend or end an engagement if you breach these Terms, provide materially misleading information, or act in a way that is unreasonable or harmful to our coordinators.
Upon termination, any deliverables completed up to that point will be shared with you; outstanding fees remain payable.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Both parties agree to the exclusive jurisdiction of the courts of Malaysia for any dispute arising from these Terms or a service engagement.
Before pursuing any formal process, we ask that you contact us at [email protected] to allow us the opportunity to resolve the matter directly. We aim to respond to any complaint within 7 business days.
If direct resolution is not possible, either party may suggest mediation through the Malaysian Mediation Centre before any other formal steps are taken.
13. General Provisions
- Entire agreement: These Terms, together with any engagement letter, form the complete understanding between you and Briarsteep for each service.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any right under these Terms on one occasion does not waive that right on future occasions.
- Assignment: You may not assign your rights or obligations under these Terms to another party without our written agreement.
- Notices: All formal notices under these Terms should be sent in writing to the address below or to [email protected].
14. Changes to Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For active engagements, we will notify you directly of any material changes before they take effect.
Your continued use of our website after an update constitutes acceptance of the revised Terms.
